Terms of Service
1. What Listora is
Listora is an advertising platform for vacation properties. Owners pay a flat fee to publish a listing for a fixed term. Visitors and buyers browse those listings and contact owners directly.
2. What Listora is not
Listora is not a broker, an agent, a travel agency, or an escrow service. We do not take reservations, hold dates, collect rental payments, hold funds, or pay owners out. We take no commission on anything agreed between users.
Listora is not a party to any agreement between a listing owner and a traveler or buyer. Dates, price, terms, and payment are agreed and settled directly between those two parties. We do not guarantee, insure, or underwrite any such arrangement.
3. No payment is taken on this site
Listora does not process payments through this website. We hold no card details, no bank details, and no merchant account for user transactions. Advertising plans are arranged with us directly.
We will never ask you to send funds to Listora in connection with a listing. If anyone asks you to do so, it is not us.
4. Accounts
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be legally capable of entering a binding agreement in your jurisdiction.
Browsing listings and contacting owners does not require an account. Advertising a listing does.
5. Listings and ownership verification
Before a listing is published we review documentation supplied by the owner — a deed, club statement, or membership certificate — and check that it matches the details in the listing. Verification confirms that the person advertising holds what they claim to hold, and that the stated property, location, and availability match the documentation as at the date of review.
Verification does not confirm the condition of any property, its availability on any date, or the terms subsequently agreed between users. Owners are solely responsible for the accuracy of their listings and must keep them accurate.
6. Advertising plans and terms
A plan buys a fixed advertising term for one listing, beginning on the date the listing is published rather than the date it was submitted. Plan features, including placement and photo allowances, are described on the Pricing page.
We may decline to publish, or may remove, any listing that fails verification, is inaccurate, or breaches these terms.
7. Inquiries and offers
A traveler may send an inquiry or a priced offer to an owner through the site. Offers expire automatically after the period stated at the time of submission.
Acceptance of an offer exchanges contact details between the two parties and closes our record of it. It does not reserve dates, create a booking, or transfer any money.
8. Acceptable use
You must not post false, misleading, or fraudulent content; advertise property you do not hold; harvest other users' details; use the site to send unsolicited commercial messages; or interfere with the operation or security of the service.
9. Content you provide
You retain ownership of content you upload. You grant Listora a non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content for the purpose of operating and promoting the marketplace and your listing.
You confirm you hold the rights necessary to grant that licence, including for any photographs.
10. Disclaimers
The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law we disclaim all warranties, express or implied. We do not warrant that listings are accurate, that any transaction will complete, or that the service will be uninterrupted or error-free.
11. Limitation of liability
To the fullest extent permitted by law, Listora is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of a transaction or dispute between users.
Our aggregate liability arising out of or relating to these terms is limited to the advertising fees you paid to Listora in the twelve months preceding the claim.
12. Indemnity
You agree to indemnify Listora against claims, losses, and expenses arising out of your listings, your use of the service, your breach of these terms, or any dispute between you and another user.
13. Suspension and termination
We may suspend or terminate an account that breaches these terms or that we reasonably believe presents a risk to other users. You may close your account at any time.
14. Changes to these terms
We may amend these terms. Each version is recorded with its own identifier and content hash, and where a change is material we will require acceptance of the new version before continued use of an account.
15. Governing law
These terms are governed by the laws of the United States and of the state in which Listora is established, without regard to conflict-of-law rules.
